Does anyone know a solution on how to define a trim box ONLY if you don't have one. But if there is then don't touch it.

You could try "Select page by its page box properties." Set it to select pages where the rim box isn't defined, then. change the trim box to whatever it needs to be. It will ignore pages that have a trim defined, regardless of size.
